Background Check Law for Nursing Home Owners Creates Questions

Nursing home owners in the state of Georgia now are subject to the same requirements as frontline caregivers and other employees who interact with residents. Beginning Oct. 1, 2019, employees, owners and administrators will be required to undergo fingerprint background checks, according to Arnall Golden Gregory, LLP. Long-term caregivers also will be required to submit to a check of the state’s sex offender registry, as well as other states where the owner lived in the past two years. The law exempts “passive investors” who don’t directly oversee operations, but it remains unclear how the term “owner” is defined.
