Wegmans Food Markets has been accused of violating the Fair Credit Reporting Act (FCRA) in a lawsuit alleging the company failed to give proper notification to job applicants and employees prior to a routine consumer background screening process. The two accusers, both from New York State, are represented by Wheeler and Brewster, who has filed the lawsuit as a class action on behalf of those who applied to the market in the past five years. While the law firm did conclude that the store includes authorization to conduct a background check in its standard electronic documents, it failed to make clear that a consumer report would be obtained. Additionally, the document contained wording that releases Wegmans for all liabilities related to information found in the background check. Wheeler and Brewster allege that the inclusion of this provision in the same document is a direct violation of the FCRA.
