Although the legalization of recreational use of marijuana is still up for debate, the courts have granted legal access to marijuana for individuals with a medical need. In response to courts requiring “reasonable access” to a legal source of medical marijuana, the Government of Canada implemented the Access to Cannabis for Medical Purposes Regulations to improve access to the drug. While physicians are becoming more at ease in prescribing marijuana for medical purposes, employers have a duty to accommodate their “disabled employees.” This, however, conflicts with their desire for a drug-free environment. Due to its current classification, prescribed marijuana should be treated as any other prescription drug that affects an individual’s ability to safely and effectively perform his or her duties.
