Although cannabis usage is now legal in the State of California, employers may still prohibit its use in the workplace. Effective in January, California legalized the “recreational” use of cannabis for adults 21 years and older. Proposition 64, the Adult Use of Marijuana Act, contains a number of limitations regarding cannabis use, including prohibiting it in public places and providing employers with the right to prohibit employees from using marijuana in the workplace. Employers may conduct drug testing only in limited circumstances and should consider updating its job descriptions of safety-sensitive positions to include a “no drug” policy.
