Already mandatory for federal contractors, some state contractors and companies that want to participate in the science, technology, engineering and mathematics (STEM) Optional Practical Training program, E-Verify could soon become mandatory for all U.S. employers. The system could replace Form I-9. The Bill recently written by Sen. Chuck Grassley (R-IA) requires federal agencies, contractors and critical employers to participate in E-Verify and all U.S. employers to participate within one year of enactment of the Act. Employers using a contract, subcontract or exchange to obtain labor also will utilize E-Verify. The bill also authorizes the verification of individuals before they are hired, recruited or referred if the individual so consents. Failure to comply will be treated as a violation of the INA requirement.
