California Civil Rights Department (CRD) Ramps Up Enforcement of the California Fair Chance Act (FCRA)

The California Civil Rights Department has intensified enforcement of the Fair Chance Act, which restricts how
employers use conviction history in hiring. Employers cannot ask about or consider criminal records before offering a
conditional job offer; after that, California law requires an individualized assessment, preliminary notice, response
opportunity, and formal adverse‐action notice. The CRD interprets the law broadly and is pursuing more administrative
charges and lawsuits.
