Although not all state drug testing laws include provisions for alcohol testing, many states defer to the federal standards and require workplace alcohol tests to be conducted in accordance with the Substance Abuse and Mental Health Services Administration guidelines and/or the U.S. Department of Transportation (DOT) regulations. Iowa is one state that has a mandatory drug and alcohol testing law and requires the use of federal alcohol testing standards. The law refers to alcohol testing numerous times and specifies that only devices that appear on the Conforming Products List (CPL) may be used in the state. Those who administer the testing must be certified as such. Wyoming is a state that has a voluntary drug and alcohol testing law, which only applies to companies that choose to participate in a program that affords a workers’ compensation premium discount to participants.
