In April, West Virginia Governor Jim Justice signed legislation that legalizes the use of medical marijuana for those with serious medical conditions. The drug may only be dispensed as pills, oil, topical forms, vaporization, nebulization, tincture, liquid or dermal patch. Provisions in the Act state that no employer may discharge, threaten, refuse or otherwise discriminate or retaliate against an employee who is certified to use medical cannabis. Employers are not required to make an accommodation of the use of medical cannabis on the property or premises of any place of employment, nor are they required to commit an act that would put the employer or any person acting on its behalf in violation of federal law. The Act includes specific provisions for safety-sensitive jobs.
