A recent Florida appellate court decision ruled that employers generally are not required to accommodate employees’
off-duty medical marijuana use under the Florida Civil Rights Act. The decision reversed a lower court ruling that had
favored an employee and reinforced employers’ ability to enforce drug-free workplace policies. The ruling shows
ongoing tension between state medical marijuana laws, disability accommodation claims, and federal cannabis
restrictions, and Florida employers should continue maintaining strict workplace drug policies.
